PRAYER:The criminal original petition filed under Section 528 of BNSS Act, to call for the records in pursuant to case in FIR No.1484/2020 pending on the file of the 1st respondent police and quash the same and pass such further or other orders.

ORDER
This criminal original petition has been filed to call for the records in pursuant to case in FIR No.1484/2020 pending on the file of the 1st respondent police and quash the same.
2.The contention of the petitioners is that the first petitioner is father and the second petitioner is mother and the third petitioner is sister of A1. Initially, a case under Section 174 registered and after 4 years, a case has been altered to Section 306 and 498 A IPC. The petitioners have no dispute with the deceased and they have been falsely implicated in this case since they are the family members of A1.
3.The learned Additional Public Prosecutor appearing for the first respondent submitted that A1 in this case was earlier married and got divorced and thereafter, developed a relationship with the victim girl and both living together. Subsequently, A1 deserted her and went to Andra Pradesh. This was questioned by the deceased, who went to the house of the petitioners and questioned them. At that time, the petitioners abused her and asked her to go and die. Thereafter, she consumed excessive medicine and ended her life. The case was initially closed as mistake of fact and action dropped. Subsequently, protest petition filed and thereafter, case was altered and investigation is now in progress. Hence, there was some delay. The points raised by the petitioners will be considered by the investigating officer. As on date, materials against the petitioners, are being analysed.
4.Considering the submissions made and on perusal of the materials available on record, it is seen that the investigation is in progress and the materials against the petitioners are being considered. Hence, this court is not inclined to entertain the criminal original petition. Accordingly, the criminal original petition is dismissed. Consequently, connected miscellaneous petition is closed.
