This Civil Miscellaneous Petition has been filed seeking to accept the cause title of the petitioner in the above second appeal.

2. Mr.M.R.Jothimanian, learned counsel for petitioners submitted that the first appellate court passed the judgment and decree on 23.04.2024 and the copy application was made on 25.04.2024 and the same was made ready on 13.06.2024. Thereafter, he has made a request to rectify the cause title of judgment and decree, which has been passed against a dead person and also application was filed by legal representatives of original appellant was allowed on 22.12.2022 in IA.No.5 of 2022 and thereafter amendment ordered on 01.02.2023 made in I.A.No.3 of 2022. Despite that, no correction was carried out by the 1st appellate court and delivered the original judgment and decree dated 24.04.2024 made in A.S.No.28 of 2018 without any correction. Hence, it is just and necessary to file the present petitions praying to accept the cause title.

3. Considering the facts and circumstances, and being satisfied with the reasons assigned in the affidavit as justifiable one, this petition is allowed. Registry is directed to carry out necessary amendment in the cause title and to number the above Second Appeals it is otherwise found to be in order and post the matter on 30.04.2025.
