Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents 1 to 2 to take immediate action to prevent unauthorized development by way of installation of Gas Pipeline, Gas Storage or Gas Regulating Controller or any other handling of explosive substance in Plot No.37 in residential lay out situated S.F.No. in 60/1A corresponding to present sub division survey number 60/1A1A of Vellalur Village, Coimbatore District by considering our representation dated 22.04.2024 and 23.05.2024.

This writ petition has been filed seeking issuance of Writ of Mandamus directing the respondents 1 to 2 to take immediate action to prevent unauthorized development by way of installation of Gas Pipeline, Gas Storage or Gas Regulating Controller or any other handling of explosive substance in Plot No.37 in residential lay out situated S.F.No. in 60/1A corresponding to present sub division survey number 60/1A1A of Vellalur Village, Coimbatore District by considering the petitioners representations dated 22.04.2024 and 23.05.2024. 2/5

2.The learned counsel appearing for the petitioners submitted that the petitioners are the owners of Plot Nos.34, 35, 36, 38 and they purchased the plots with fond hope to construct houses in the same and live peacefully, however, respondents 3 and 4 purchased Plot No.37 for the purpose of installation of explosive substance of Gas Pipeline, Gas Storage, Gas Regulating Controller and objecting the same, they made representation to the respondents, however, there is no response. Hence, this Court may without going into the merits of the case, issue direction to the respondents 1 and 2 to consider the petitioners representations dated 22.04.2024 and 23.05.2024 and to pass appropriate orders, within a reasonable time frame. 3.

Considering the limited relief now sought for by the learned counsel appearing for the petitioners, this Court without expressing any opinion on the merits of the case, directs the respondents 1 and 2 consider the petitioners representations dated 22.04.2024 and 23.05.2024, on merits and in accordance with law, and pass appropriate orders after providing opportunity to the respondents 3 and 4, within a period of six weeks from the date of receipt of a copy of this order, if not already considered.
