This Criminal Original Petition has been filed to direct the 2nd respondent not to harass the petitioner and his family members under the guise of enquiry, except in due process of law.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for respondents 1 and 2.

3. Considering the submissions and upon perusal of the materials on record, it is seen that the defacto complainant is the wife of the petitioner. The petitioner and the defacto complainant got married on 15.02.2024 and now the defacto complainant have been thrown out of the residence and is on the street. For that reason, seeking shelter, she had lodged a complaint.

4. In any event, since it is a matrimonial dispute, the petitioner is directed to appear before the 2nd respondent on 27.04.2026, without fail. Thereafter, the 2nd respondent police shall conduct an enquiry and if needed, refer the matter to the Social Welfare Officer. Page No.2 of 4
