PRAYER in W.P.No.13957/2020: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Declaration, to declare that the impugned action of respondent Nos.1 to 6 in cancelling the patta issued in favour of Rajan Dev in respect of the project titled "Casa Grande Elan" developed on Survey No.163/1 in Thalambur Village and issued in favour of S.Nagarajan, Hasan Ali Alim, Rajan Dec and Benin Rajesh Kumar in respect of the project titled "Casa Grande Elan" developed on Survey Nos.163/2 and 164/2 in Thalambur Village and its subsequent modification as 'Government Land' are illegal, unlawful, arbitrary and unconstitutional.
PRAYER in W.P.No.13958/2020: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondent Nos.1 to 6 herein to transfer/issue patta in favour of Rajan Dev in respect of the project titled "Casa Grande Elan" developed on Survey No.163/1 in Thalambur Village and in favour of S.Nagarajan, Hasan Ali Alim, Rajan Dec and Benin Rajesh Kumar in respect of the project titled "Casa Grande Elan" developed on Survey Nos.163/2 and 164/2 in Thalambur Village.

The petitioners further seek a direction to issue patta in favour of Rajan Dev in respect of the project titled "Casa Grande Elan" developed on Survey No.163/1 in Thalambur Village.

The learned Additional Advocate General appearing on behalf of the State would submit that the Hon'ble First Bench of this Court passed an order constituting a Committee to conduct a survey of the subject property in Thazhambur Village, Chengalpattu District and that the Committee has undertaken the process of identifying the irregularities, illegalities and encroachments etc.,

Since a Committee has already been constituted and has initiated action to conduct the survey and for further actions, no adjudication on the grounds raised in the present writ petition needs to be undertaken at this stage. The matter is now sub judice before the Hon'ble Supreme Court. Subject to the orders of the Hon'ble Supreme Court, the parties are at liberty to redress their grievance, if any exist in the manner known to law. 4/6
