Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus, directing the 4th respondent to consider the petitioner's Application No.2024/0123 /33/003382 dated 19.09.2024 to survey the petitioner's Ayan Punja lands measuring 2 Acres 20 cents (1.46.5 Hectares), comprised in Survey No.131/3, as per the Deed of Sale dated 18.03.1993, registered as Document No.238 of 1993 and Deed of Rectification dated 02.09.2013, registered as Document No.1219 of 2013, situated in Kandikkal Village, Kalvarayanmalai Panchayat, Kalvarayanmalai Taluk, Kallakurichi District, as per the direction the 2nd respondent by their Letter C.Pa No. A4/362/2024 dated 26.10.2024.

This writ petition has been filed for issue of a writ of mandamus directing the fourth respondent to act upon the application submitted by the petitioner on 19.09.2024, wherein the petitioner has sought for conducting survey in the subject property.

2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents. 2/4

3. The petitioner is placing reliance upon the Rectification Deed dated 02.09.2013 and Sale Deed dated 18.03.1993. The petitioner submitted an application dated 19.09.2024 by paying necessary charges for conducting the survey. Since the same was not acted upon, the petitioner made a representation dated 26.09.2024, but the same did not evoke any response. SMS message has been received as if survey was conducted but no such survey was conducted.

4. Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, there shall be a direction to the fourth respondent to act upon the application submitted by the petitioner on 19.09.2024 and conduct survey in the subject property based on the title documents that are relied upon by the petitioner. This process shall be completed within a period of four weeks from the date of a receipt of a copy of this order.
