Prayer: Criminal Original Petition filed under Section 482 of Cr.P.C. to direct the respondent to execute the Non Bailable Warrant dated 16.8.2013 issued by the learned XIII Metropolitan Magistrate, Saidapet, Chennai in C.C.No.14475 of 2009.

O R D E R

Seeking a direction to the Respondent police to execute the Non Bailable Warrant dated 16.8.2013 issued by the Learned XIII Metropolitan Magistrate,Saidapet, Chennai i C.C.No.14475 of 2009, the petitioner has come up with this petition.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent police. 3.

It is seen that the case in C.C.No.14475 of 2009 was pending on the file of XIII Metropolitan Magistrate, Saidapet, Chennai, without any progress, since one of the accused by name Munusamy, s/o.Govindasamy, absconded. The other two accused by name, Rajeev and Pitchai are attending the court. A direction is issued to the respondent police to execute the non bailable warrant expeditiously and a further direction is issued to the respondent police to file an appropriate application for splitting up the case. As against other accused, steps to be taken for declaring the absconding accused as proclaimed offender.

The Trial Court shall proceed with on such application being made by the prosecution, the case shall be split up and proceed with the trial as regards the other accused.

With the above direction this Criminal Original Petition is closed.
