ORDER

This Criminal Original Petition has been filed to call for records and quash all further proceedings in C.C.No.5062/2010 on the file of the XVI Metropolitan Magistrate, George Town, Chennai.

2. When the matter is taken up for hearing, the learned counsel appearing for the petitioner submitted that the final report, in this case, was filed as early as in the year 2010 and till date, the prosecution has not yet commenced. He further submitted that the defacto complaint, in this case, is an advocate and that is why the prosecution is not even summoning her for giving evidence.

3. The allegation against the petitioner is for offence under Sections 294(b), and 506(i) IPC. The adjudication shows that the petitioner has been diligently appearing before the trial Court. There are only six witnesses cited in the memo of evidence.

4. Under such circumstances, the XVI Metropolitan Magistrate, George Town, Chennai, is directed to complete the trial in C.C.No.5062 of 2010 within a period of three months from the date of receipt of a copy of this order.

With the above observation, the criminal original petition is closed. Consequently, connected miscellaneous petition is closed. 12.08.2016 sms
