Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the first respondent herein to consider and pass orders on the petitioner's representation dated 09.06.2017 given for promotion as Deputy Superintendent of Police (Cat-i) in accordance with Section 7(1) Schedule XI Part-A II Paragraph

ORDER

The restricted relief sought for by the writ petitioner in this writ petition is for a direction to consider the representation submitted by the writ petitioner on 09.06.2017, seeking promotion to the post of Deputy Superintendent of Police in accordance with the Act and Rules. The writ petitioner is now working as Inspector of Police and he was subjected to Disciplinary Proceedings, on account of the criminal case registered against him.

The Criminal case, on appeal ended with an order of Acquittal and the Disciplinary Proceedings against the writ petitioner were also dropped. Consequently, he was reinstated in service and his original seniority in the cadre of Sub Inspector was also restored. Since, the seniority was restored, the writ petitioner submitted the representation on 09.07.2017 to consider him for further promotion to the post of Deputy Superintendent of Police in accordance with rules and the same is pending before the 1st respondent.

Without going into the merits and demerits of the case, the 1st respondent is directed to consider the representation submitted by the writ petitioner on 09.07.2017 and pass final orders within a period of twelve weeks from the date of receipt of a copy of this order. The writ petitioner is also directed to enclose the copy of representation along with the order passed in this writ petition.

In the result, the writ petition stands disposed off. No costs.
