The petitioner, who was arrested and remanded to judicial custody on 21.08.2020 for the offences punishable under Sections 364, 394 r/w 397 & 302 of IPC in SC.No.94 of 2017 on the file of the learned III Additional District and Sessions Judge, Thiruppur District in respect of crime No.472 of 2015 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that it is a case of jumped bail and the petitioner is one of the accused in SC.No.94 of 2017 and the petitioner did not appear before the trial court on 11.02.2019. Therefore, NBW was issued against him and on execution of NBW, he was arrested and remanded to judicial custody on 21.08.2020.
3. The learned counsel for the petitioner would submit that only due to illness, the petitioner was unable to appear before the trial court. He would further submit that the petitioner is ready to abide by any condition as imposed by this Court. Hence, he seeks for grant of bail to the petitioner.
4. The Additional Public Prosecutor appearing for the respondent police would submit that the petitioner has 11 previous cases and he was arrested with great difficulty on execution of non bailable warrant. Hence, he vehemently opposed to grant bail to the petitioner.
5. It is seen that the petitioner, who has bad antecedents, has 11 previous cases similar in nature. He was arrested only on execution of non bailable warrant. If he is let out on bail, he will again abscond and it will be very difficult for the respondent police to secure him. Therefore, this Court is not inclined to grant bail to the petitioner. Further, the earlier bail petitions filed by the petitioner were dismissed by this Court and this is the four bail petition. Even then, there is no change of circumstances in this case.
6. Accordingly, this criminal original petition is dismissed. However, the trial court is directed to complete the trial in SC.No.94 of 2017 within a period of six months from the date of receipt of copy of this order. 08.07.2022 lok
