The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 406 and 420 of IPC in Crime No.52 of 2025, on the file of the respondent Police, seek anticipatory bail.
2. The allegation against the petitioners is that A1 introduced the defacto complainant to invest the amount to the tune of Rs.88,00,000/- in a private bank. On receipt of the money, the petitioners had failed to return back the money to the de-facto complainant. In this regard, A1 was arrested and remanded to judicial custody. Hence, the case.
3. The learned counsel for the petitioners submits that the petitioners had already paid a sum of Rs.1,34,00,000/- to the de-facto complainant through bank transfer. He also submits that the petitioners are ready to abide by any conditions that may be imposed by this Court and ready to furnish sufficient solvent sureties for their release. Hence, he prays for grant of anticipatory bail to the petitioners.

The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and submits that the petitioners herein had received a sum of Rs.14,74,000/- from the de-facto complainant and they had not returned back the money and thereafter, the petitioners cheated the de-facto complainant. He also submits that no amount has been recovered from the petitioners so far. He opposed to grant anticipatory bail to the petitioners.
5.Considering the fact that the gravity of offence committed by the petitioners and no amount has been recovered from the petitioners so far; that the investigation is pending, this Court is not inclined to grant anticipatory bail to the petitioners.
6. Accordingly, this Criminal Original Petition is dismissed. 12.11.2025 MSM 3/3
