COMMON ORDER This common order will dispose of all these 65 writ petitions.

Dr.Father Xavier Arul Raj, Senior Counsel instructed by Ms.A.Arulmary, Mr.D.Baskar, Ms.Hema Muralikrishnan, Mr.K.Chandrasekaran, Mr.G.Sankaran, Mr.B.R.Shankaralingam, Mr.P.Ebenezer Paul and Mr.S.Thanka Sivan, learned counsel on record on behalf of all the writ petitioners, Mr.Vijay Narayan, learned Advocate General instructed by Mr.T.C.Gopalakrishnan and Ms.Karthika Ashok, learned Standing Counsel for Chennai Corporation and Mr.R.P.Prathapsingh, learned Government Advocate on behalf of the other co-respondents i.e., other than Chennai Corporation and its officers are before this Court.

The central theme and the core issue in these writ petitions is heavily dependant on outcome of a batch of writ petitions being W.P.No.18008 of 2018 etc., This Court is informed that a Hon'ble Division Bench of this Court is in seizin of this batch of writ petitions, wherein the vires of Act No.6 of 2018 which came into force on and from 25.01.2018 is under challenge. This Court is also informed that the batch of writ petitions have been heard out by a Hon'ble Division Bench and orders have been reserved.

To appreciate how the batch of writ petitions which Hon'ble Division Bench is seizin would impact the central theme/core issue in these writ petitions, short facts shorn of micro details would suffice and that short facts are that writ petitioners have assailed inter alia a resolution made by Chennai Corporation, being a resolution dated 10.04.

2018 deciding to levy surcharge ata flat rate of 60% qua property tax with regard to buildings used for educational purposes being Government aided institutions as well as private educational institutions, that the consequent assessment orders and demand notices have also been called in question, that the portion of the impugned resolution which impacts the writ petitioner has been made pursuant to an amendment to Section 101 (c) of 'Chennai City Municipal Corporation Act, 1919', ('CCMC Act' for brevity), that amendment to Section 101 (c) of CCMC Act has been brought in by Act No.6 of 2018 which came into force on and from 25.01.2018 and that the vires of Act No.6 of 2018 is under challenge in the batch of writ petitions mentioned herein (which this Court is informed a Hon'ble Division Bench is in seizen).

5. It therefore follows as a sequitur that any challenge to the impugned resolution or any portion thereof can be gone into only after the Hon'ble Division Bench decides on the vires of Act No.6 of 2018.

6. As far as the impugned resolution and demand of 60% of surcharge qua writ petitioners is concerned, there is no disputation or disagreement before this Court that pursuant to pendency of the matter before a Hon'ble Division Bench, the same has been kept in abeyance, that position continues in respect of the writ petitioners before the Division Bench and in respect of the writ petitioners herein. There is no disputation that this position is now operating even as of today.

Learned Advocate General submits that though obvious, this position will continue to operate till the disposal of said batch of writ petitions i.e., W.P.No.18008 of 2018 etc., batch and that further proceedings if any will depend on the out come of challenge to vires before the Hon'ble Division Bench.

8. Learned counsel for writ petitioner submits that main writ petition can be disposed of in the light of the aforesaid stated position of State and Chennai Corporation, leaving open all questions pertaining to challenge to impugned resolution, consequential assessments and demands.

9. Though obvious, it is made clear that in this order, this Court is not expressing any view or opinion on the challenge to the impugned resolution, consequential assessments and demands as well as the position to the same.

10. Therefore, this now becomes a consent order.

11. Learned Senior Counsel and counsel for writ petitioners submit that their rights to assail the impugned resolution afresh if the need arises depending on the outcome qua W.P.18008 of 2019 etc., batch may be preserved. The rights are preserved leaving open all questions as alluded to supra.
