[Order of the Court was made by M. SUNDAR, J.] Captioned matter turns on a very narrow compass.
2. Short facts are that R5 (private respondent) come to this Court with a 'Removal of Encroachment' {'RoE'} prayer vide W.P.No.12115 of 2024; that this writ petition came to be disposed of by a Division Bench vide order dated 07.06.2024 to which one of us (M.Sundar J.,) was a party and that thereafter, R5 filed a contempt being Contempt Petition No.3723 of 2024 which was closed recording the stated position that Revenue Divisional Officer has passed an 'order dated 13.03.2025 bearing reference Page Nos.2/4
Na.Ka.No.05/2025/Ci' {hereinafter 'said order' for the sake of brevity, convenience and clarity}. A soft copy of said order has been served on the learned counsel for writ petitioner today and learned counsel for writ petitioner confirms receipt of the same.
3. All questions raised in the captioned WP are left open as regards the writ petitioner as well as R5 as the writ petitioner now wants to assail the said order. All rights and contentions of the writ petitioner including the contentions raised in the main WP are preserved for this purpose.
4. We make it clear that this order will not impact the rights of R5 in any manner therefore, notice to private respondent (R5) is dispensed with and the main WP is taken up with the consent of learned counsel for writ petitioner and learned State counsel in the Admission Board itself. Page Nos.3/4
M.SUNDAR, J., and HEMANT CHANDANGOUDAR, J., mk Captioned WP and captioned WMP thereat disposed of as closed albeit with preservation of rights as already alluded to supra. There shall be no order as to costs.
