PRAYER : This criminal miscellaneous petition has been filed under Section 528 of BNSS, 2023, to permit the petitioner herein to travel to Malaysia on 06.05.2025 and return back to India on 03.06.2025 in Crl.O.P.No.21638 of 2024.

ORDER
This Court, by an order dated 12.09.2024 in Crl.O.P.No.21638 of 2024, had imposed the condition no.7(c), which reads as follows: (c) The petitioner shall not leave India without the previous permission of the Court;
2(a). The learned counsel for the petitioner would submit that the Final Report has been filed and the Charges also have been framed by the Trial Court; that the petitioner intends to travel abroad for a period of thirty days commencing from 06.05.2025 to 03.06.2025 and sought permission to do so; and that the petitioner had also filed an affidavit mentioning the date of departure and also the date of arrival.
(b). The learned counsel further submitted that earlier this Court had permitted him to travel to Malaysia for visiting his son from 16.11.2024 to 15.12.2024 and the petitioner had returned on time. Page No.2 of 5
4. Heard the learned Government Advocate (Crl.Side) for the respondent.
5. Considering the aforesaid facts, this Court is inclined to permit the petitioner to travel abroad between the period from 06.05.2025 to 03.06.2025.
6. Pursuant to the earlier order, the petitioner had deposited title deeds. It is made clear that the title deeds shall remain in the custody of the Court until further orders.
7. This Criminal Miscellaneous Petition is ordered accordingly. 28.04.2025 dk Note: Issue order copy by 30.04.2025.
