ORDER
The petitioner, who was arrested and remanded to judicial custody on 09.01.2025 for the alleged offence under Sections 8(c) r/w. 20(b)(ii)(c) of NDPS Act in Crime No.13 of 2025 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that on 09.01.2024, while the respondent was in the station duty received the special report from one Krishnamoorthy who is the Sub Inspector of Police stating that on 09.01.2025 at about 08.00 hours to 09.00 hours, the petitioner was involved in the sale of prohibited Ganja at Balaji Dental College and Hospital. On receipt of the said information, the respondent went to the place of occurrence and identified the petitioner and explained rights of the accused as per NDPS act and search made over to the petitioner and seized 11 pocket of 2 Kg of Ganja packet totally 22 kgs from the petitioner and remanded the petitioner into the Judicial custody.
3. The learned counsel for the petitioner submitted that the petitioner is having permanent address and he is speaking Telugu only and he has been falsely implicated in this case. He further stated that the petitioner is not having any previous case and prays to grant bail.
4. The learned Government Advocate (Crl.Side) submitted that the petitioner is found in possession of 22 kgs of Ganja which is a commercial quantity and Section 37 of NDPS Act is applicable in this case and opposed to grant bail to the petitioner.
5. Considering the fact that the case involved herein is a commercial quantity and Rigors of Section 37 of NDPS Act is applicable. However, the petitioner has not made out any grounds to satisfy Section 37 of NDPS Act. Hence, I am not inclined to grant bail to the petitioner.
