This petition has been filed to direct the Mahila Court, Chengalpet, Kancheepuram District to dispose S.C.No.43 of 2018 pending on its filed within a time frame.
2. Pursuant to the order dated 17.07.2018, the Mahila Judge, (Sessions level), Chengalpattu, has sent a report dated 25.07.2018, wherein, he has stated as follows: "I further submit that on 02.04.2018, the accused has appeared and Ms.Sheik Mahranuisha, filed a memo of appearance to defend the case. The case properties has not been submitted and again a memorandum issued to the learned Judicial Magistrate, Alandur to submit the case property on or before 2.5.2018 and for further proceedings u/s 226 Cr.P.C. On that day, the accused present. Case properties not received. Again issued a memorandum to the learned Judicial Magistrate, Alandur to submit the case properties on or before 1.6.2018. On that day, the accused present and reposted to 2.7.2018 and send a reminder to learned Judicial Magistrate, Alandur. On that day, the accused present. Further, I humbly submit that the trial not yet commenced since the proceedings u/s 226 Cr.P.C. has not been completed and the case properties not yet received from learned Judicial Magistrate, Alandur. I pray that the Hon'ble High Court, Madras to accept the above report and render justice."
3. In view of the above, this Court directs the Judicial Magistrate, Alandur, to send the case properties in PRC.No.16 of 2014 to the Mahila Court, Chengalpattu, immediately. The Mahila Judge, Chengalpattu, is directed to expeditiously complete the trial in S.C.No.43 of 2018.
