ORDER

This Criminal Original Petition has been filed seeking for a direction to declare the acquittal of the petitioners in C.C.No.274 of 2015 as an Hon'ble acquittal.

A reading of the judgment dated 07.03.2016 made in C.C.No.274 of 2016, does not indicate that the petitioners were acquitted by giving the benefit of doubt. The Trial Court has categorically stated that the prosecution has failed to prove the charges against the petitioners. Therefore, it is not necessary for this Court to again reiterate that it is an Hon'ble acquittal. That apart, there is also an order passed by the Deputy Inspector General, Prisons dated 12.09.2016, wherein after the enquiry was conducted in the disciplinary proceedings, the punishment of dismissal of service was confirmed by the said authority. It is left open to the petitioners to agitate their grievance as against the disciplinary proceedings in the manner known to law and this Court in exercise of its jurisdiction under Section 482 of Cr.P.C cannot interfere with the same. https://hcservices.ecourts.gov.in/hcservices/

In the result, no further orders are required to be passed in this Criminal Original Petition and accordingly, this Criminal Original Petition is disposed of.
