ORDER

This company petition is filed seeking to order winding up of the respondent company under the provisions of the Companies Act, 1956 and to appoint the Official Liquidator, High Court, Madras, as the Provisional Liquidator of the said company with all powers under Section 448 of the Companies Act, 1956 to take charge of the assets, properties, stock in trade and books of accounts of the company.

2. When the matter is taken up for hearing today i.e.,on 11.12.2017, the learned counsel for the respondent would submit that the company is already in liquidation and the Official Liquidator has taken charge having been appointed as provisional liquidator in Company Application No.274 of 2010. He has also produced the order passed by this court on 18.06.2014 in support of the same.

3. In view of the same, this company petition stands closed giving liberty to the petitioner to raise the claim before the Official Liquidator.
