This petition has been filed seeking to condone the delay of 348 days in filing the Civil Miscellaneous Appeal.

Mr.D.Manimaran, the learned counsel who appeared on behalf of the first respondent, stated that he has no objection to this petition being allowed.

Though notice has been served on the second respondent and his name is printed in the cause list, there is no representation on his behalf.

The reasons adduced in the affidavit filed in support of this petition being satisfactory, this Civil Miscellaneous Petition is ordered and consequently, the delay of 348 days in filing the appeal is condoned, subject to the condition that the claimants/petitioners will not be entitled to interest for the delay period i.e., for 348 days, in the appeal.
