ORDER
The present writ petition is filed praying for a writ of Mandamus forbearing respondents 1 and 2 from disbursing the entire death-cum-retirement benefits of the petitioner's deceased Father M.Xavier (Employment Code No.54008) to the 3rd respondent exclusively and direct the respondents 1 and 2 to disburse the same to the petitioner and the 3rd respondent equally.
2. When it was suggested that the representation which has already been made by the petitioner may be considered and appropriate orders may be passed after issuing notice to the petitioner, respondent as well as any other interested parties, in accordance with law/ circulars, learned counsel for petitioner as well as respondents agreed to the above suggestion.
3. In view thereof, the writ petition is disposed of with a direction to the appropriate respondent to consider the representation and pass appropriate orders in accordance with law after issuing notice to petitioner, respondent as well as any other interested parties, within a period of 8 weeks from the date of receipt of a copy of this order. All rights and contentions of the parties are left
open. It is made clear that this Court has not expressed any opinion on the merits of the case. No costs. Consequently, the connected miscellaneous petition is closed.
