Criminal Original Petition filed under Section 482 of the Criminal Procedure Code praying to direct the respondents to investigate the complaint, dated 10.06.2014, given by the petitioner and to take appropriate action against the person, who illegally trespassed and attempted to raise a construction over the part of the petitioner's property, in accordance with law and to file a detailed report before the Court within the stipulated time. Heard the learned counsel for the petitioner and also the learned Additional Public Prosecutor for the respondent/Police. 2.A reading of the petitioner's complaint, 10.06.2014, reveals that the petitioner's property was encroached upon by one https://hcservices.ecourts.gov.in/hcservices/
Bakthavachalam, and he has put up construction in the portion of the property belonging to the petitioner. Hence, the efficacious remedy available to the petitioner is to file a suit for recovery of possession before the Civil Court.
