O R D E R

(The case has been heard through video conference) The petitioner, who was arrested and remanded to judicial custody on 15.09.2020 for the offence punishable under Sections 6(4) of TNSC (RDCS) order 1982 read with section 7(i) a (ii) of Essential Commodities Act, 1955, in Crime No.129 of 2019, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner was found illegally transporting 3100 kgs. of PDS rice. 3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in this case. He would further submit that the petitioner has been suffering incarceration from 15.09.2020. Hence, he seeks for grant of bail to the petitioner.

4.The learned Government Advocate (Crl. Side) appearing for the respondent would vehemently oppose stating that the petitioner is a habitual offender involved in trading of PDS rice. He would further submit that the petitioner is the owner of the rice as well as the owner of the vehicle. He would further submit that the petitioner has got two previous cases against him and the investigation is pending. https://hcservices.ecourts.gov.in/hcservices/

5. Taking into account the nature of offence and the antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed for the present.
