This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 07.05.2024, seeking bail in Crime No.165 of 2024 registered under 174(3) Cr.P.C and later altered for the alleged offences punishable under Sections 498(A) & 306 of IPC.
2. Learned counsel appearing for the petitioner submitted that the petitioner, who is none other than the husband of the victim/deceased, is an innocent person and he has been falsely implicated in this case. He further submitted that the deceased/victim was under lot of work pressure and due to the same, she had committed suicide when the petitioner is not at home. He also submitted that the petitioner has not abetted the victim to commit suicide, whereas, he is suffering incarceration from 07.05.2024 and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.
3. Learned Government Advocate (Criminal Side) appearing for the respondent police raised objection for granting bail stating that the deceased/victim was working as a Police Constable and she was given in marriage to the petitioner herein/A1 in the year 2023. He further submitted that the due to the cruelty committed by A1 and A2/ mother of the petitioner, to the victim/deceased, she has committed suicide by hanging. https://www.mhc.tn.gov.in/judis

4. He further submitted that RDO report is awaiting and this case needs a detailed investigation. Therefore, if the petitioner is released on bail at this stage, there is a possibility of him absconding and not available for further investigation.
5. Taking into consideration the facts and circumstances of this case and the submissions made by the learned Government Advocate (Criminal Side) and considering the nature and gravity of the offence committed by the accused and taking note of the fact that this case needs a detailed investigation, this Court is not inclined to grant bail to the petitioner.
