C.M.P.No.10210 of 2022 in S.A.No.1629 of 2002 KRISHNAN RAMASAMY, J., This petition has been filed by the petitioner/appellant seeking to condone the delay of 3858 days in filing the petition to set aside the abatement caused due to the death of the sole respondent in S.A.No.1629 of 2022. 2.Mr.R.Thiagarajan, learned counsel appearing for the respondents 3, 4 & 6 submitted that he has no objection in allowing the present petition. Notice served to the respondents 2 & 5, however, no one entered appearance. With regard to the 7th respondent, notice returned with an endorsement "Refused". 3.Having satisfied with the reasons stated in the affidavit filed in support of this petition, the delay is condoned and this petition is allowed. 4.Post the matter on 09.01.2023.
