J U D G M E N T

(Judgment was delivered by S.M.Subramaniam J.) The writ appeal has been instituted challenging the writ order dated 19.03.2024. The writ petitioner is the appellant before this Court.

2. The writ petition has been instituted seeking a direction to the District Registrar to initiate action and cancel the sale deed registered in Document No.1/5781/2023 dated 04.08.2022.

3. The writ petition has been instituted based on Section 77(A) of the Page No.2 of 5

Registration Act. Section 77(A) of the Registration Act, 1980 has been struck down by the Division Bench of this Court in the case of M.Kadhiravel vs. Inspector General of Registration

1. The learned Single Judge has already granted liberty to the appellant to approach the Civil Court.

4. The learned counsel for the respondent brought to the notice of this Court that the civil suit in O.S.No.39 of 2025 was instituted pending on the file of Principal District Court, Coimbatore. That being the factum, the parties are at liberty to workout their remedy before the Civil Court.

5. Accordingly, the Writ Appeal stands disposed of. Consequently, the connected Miscellaneous Petition is closed. There shall be no order as to costs.
