The petitioners, who apprehend arrest for the alleged offences under Sections 147, 148, 294(b), 323, 324, 385 and 506(ii) of IPC in Crime No.115 of 2023 on the file of the respondent police, seek anticipatory bail.

2. Based on the complaint given by the defacto complainant/Jaison, who is working as a Senior Manager at Daimler Company, that the petitioners along with other accused, who are the auto drivers, have demanded more money from the victims and when they refused to give the money, the petitioners along with other accused have abused and assaulted them and taken away Rs.600/- from them, a case in Crime No.115 of 2022 was registered for the offences punishable under Sections 147, 148, 294(b), 323, 324, 385 and 506(ii) of IPC. Hence the case. 3.The learned counsel for the petitioners would submit that the petitioners are innocent persons and they have been falsely implicated in this case, since they got some previous cases. He would further submit that

the petitioners are ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioners.

4. The learned Government Advocate (crl.side) appearing for the respondent Police would submit that the petitioners along with other accused have demanded more money from the victim and when they refused to give the same, the petitioners along with other accused have assaulted them and taken away Rs.600/- from them. He would further submit that two previous cases are pending against the first petitioner and four previous cases are pending against the second petitioner. Hence, he opposed for grant of anticipatory bail to the petitioners.

5.Heard the learned counsel for the petitioners as well as the learned Government Advocate (crl.side) and perused the entire materials available on record.

6. Taking into account the nature of offence committed by the petitioners and also the previous antecedents of the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners.

7. Accordingly, this Criminal Original Petition is dismissed. 05.06.2023 vkr
