Respondent(s) PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, seeking issuance of Writ of Mandamus, directing the respondents and their men, agents to process the petitioner's Application dated 18.12.2023 for connectivity approval for connecting 230KV 10 (1) Pooling Sub-Station to be erected at Virudunagar District for evacuating 70 MW of Solar Power by making LILO arrangement of the existing 230KV TANTRANSCO transmission line from TTPS / Sterlite to Anuppankulam Substation at 230KV level, by adhering to and according priority strictly in terms of the TNERC Open Access Regulations, 2014 and the practice followed in that regard. ORDER

This Writ Petition has been filed seeking issuance of writ of mandamus,

directing the respondents to consider the petitioner's application dated 18.12.2023.

The learned counsel for the petitioner would submit that the petitioner is a well-established renowned business conglomerate in the field of renewable energy which excels in the field of developing solar projects on turn-key/BOOT model basis for several multinational companies including the State Government and Central Government. During the month of February, 2023, one M/s.Vishnupriya Farms Private Limited was awarded the "Note-for-record st respondent herein, for the establishment, Apprval" by the TANGEDCO, 1 development and supplying of 70MW solar power to TANGEDCO from their project site at Virudhunagar District and to be connected to 230/110KV Anuppankulam Sub-Station through LILO arrangement between Anuppankulam -TTPS feeder at 230KV level. However, M/s.Vishnupriya Farms later surrendered this approval for reasons best known to them, which TANGEDCO accepted, leading to its cancellation on 21.02.2024.

The learned counsel for the petitioner submitted that after the said cancellation, the petitioner's partner, M/s.Enerparc Solar 7 Private Limited, which belongs to one of the solar project developer in the Tamil Nadu market became aware of the surrender of the solar project by the said M/s.Vishnupriya Farms Private Limited, immediately made an application on 18.12.2023 for the establishment and development of the same project. However, till date, the said application was not considered by the respondents. Hence, this present writ petition is filed.

4. The learned counsel appearing for the respondents would submit that the respondents will consider the petitioner's application dated 18.12.2023 and pass appropriate orders in accordance with law within a specified time.

5. In view of the same, the respondents are directed to consider the petitioner's application dated 18.12.2023 and pass orders on the same, in

accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.
