This miscellaneous petition has been filed by the writ petitioner seeking modification of the condition, viz., payment of a sum of Rs.2,50,000/- by the petitioner to the respondent for release of the vehicle, in the order dated 9.7.2018 passed in the writ petition.

2. In support of the prayer, the learned counsel for the petitioner submitted that since the amount specified in the order is on the higher side, the petitioner is not able to mobilize this amount.

3. In reply, the learned Additional Government Pleader for the respondent submitted that when the petitioner undertook to comply with the conditions mentioned in Section 6-A(1) of the Essential Commodities Act by paying a sum of Rs.2,50,000/- for release of the vehicle, pending enquiry, this amount was imposed as one of the conditions, with an observation that if the petitioner succeeds in the enquiry, he is entitled to get back the said amount without interest.

4. When the aforementioned amount has been ordered to be paid by the petitioner for release of the vehicle, pending enquiry, on his undertaking to comply with the conditions mentioned in Section 6-A(1) of the Essential Commodities Act, making it clear that if the petitioner succeeds in the enquiry, he is entitled to get back the said amount, this Court finds no merit in this miscellaneous petition. Accordingly, W.M.P.No.23693 of 2018 is dismissed. 26.11.2018 ss http://www.judis.nic.in
