The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offence under Sections 294(b), 323, 324, 427, 506(ii) of IPC, in Crime No.178 of 2024 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused persons have abused the defacto complainant in filthy language and attacked them, damaged the property belongs to the defacto complainant and caused injuries to him. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) submitted that the petitioner along with other accused persons have attacked the defacto complainant and caused grievous injuries to the defacto complainant. He further submitted that the petitioner has involved in serious offence and the investigation is at initial stage. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.

5. The learned counsel for the intervenor/defacto complainant submitted that the petitioner along with other accused persons have attacked the defacto complainant and caused grievous injuries to him. He further submitted that if the anticipatory bail is granted, the petitioner shall tamper the evidence. Hence, he strongly opposed for grant of anticipatory bail to the petitioner.

6. Considering the facts and circumstances of the case and also the fact that the petitioner has involved in serious offence and also considering the gravity of offence and the investigation is at initial stage,

this Court is not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, this Criminal Original Petition is dismissed. 07.06.2024 msrm
