This application is filed to recast the issues in C.S.No.832 of 2019 and frame an issue concerning the validity of the plaintiff's trademarks.
The learned counsel appearing for the applicant/2nd defendant would submit that this application was filed against the plaintiff's trademark. However due to dissolution of IPAB, the issue of validity of the plaintiff's trademark has to be decided by framing appropriate issues. The plea of the applicant/2nd defendant made in this application is taken note and an appropriate orders will be passed before finalising the case management hearing.
Post the matter on 19.07.2021.
