In respect of the above applications, after several hearings and persuasion on behalf of the respondents, the following affidavit of undertaking has been filed by the 2nd respondent herein, which is relevant for closing the above two applications.

"10. In view thereof, the Respondents hereby Undertake before this Hon'ble Court that they will not alienate or deal with Four (04) Unsold Flats viz., Flat No.A14H, Flat No.A15H, Flat No.B14H and Flat No.B15H (forming part of Schedule to the Petition seeking Furnish Security) as well as One (01) Unsold Flat bearing No.B15G (forming part of the schedule to the Petition seeking to grant Interim Injunction from alienating 155 Unsold Flats in the Project) in the subject Project, in all having a Market Value of Rs.5,94,00,308/- (Rupees Five Crores Ninety-Four Lakhs Three Hundred and Eight only), until the disposal of the present suit."

2. In view of the above undertaking that five flats as stated above 1/3

will not be alienated till the disposal of the Suit, this Court is of the considered view that interest of the applicant/plaintiff is secured adequately and no further orders need to be passed in the above applications. Therefore, these Applications are closed.
