ORDER

The wife, who is the respondent in HMOP No.125 of 2024 pending on the file of Sub Court, Dindigul is the revision petitioner herein, seeks transfer of the said proceedings to II Additional Sub Court, Coimbatore.

2. Despite service of notice, the respondent has neither chosen to appear 1/4

in person nor through counsel. Therefore, the respondent is called absent and set exparte. Therefore, I have proceeded to hear the learned counsel for the petitioner.

3. Learned counsel for the petitioner states that the petitioner/wife has instituted HMOP No.499 of 2024 before the Family Court, Coimbatore and therefore, she seeks transfer of HMOP No.125 of 2024 from the file of Sub Court, Dindigul. Learned counsel further states that the petitioner/wife finds it difficult to travel all the way from Sulur to Dindigul to attend the proceedings initiated by the respondent/husband.

4. I have gone through the affidavit filed in support of the transfer petition. Considering the fact that HMOP No.499 of 2024 initiated by the petitioner/wife is pending before the Family Court, Coimbatore, no prejudice would be caused to the respondent/husband if HMOP No.125 of 2024 pending on the file of Sub Court, Dindigul is transferred to Family Court, Coimbatore.

5. Accordingly, Tr.C.M.P is allowed and the proceedings in HMOP No.479 of 2025 pending on the file of Sub Court, Dindigul is withdrawn and the same is transferred to Family Court, Coimbatore to be tried along with 2/4

HMOP No. No.499 of 2024 initiated by the petitioner/wife.
