Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the respondent to pass orders on the disciplinary proceedings initiated against him in RDC(S) Na.Ka.No./A2/6751/2016 dated 09.01.2017 within a reasonable time. For Petitioner :

ORDER

The restricted prayer sought for in this writ petition is to direct the respondents to pass orders on the disciplinary proceedings initiated against the petitioner in proceedings dated 09.01.2017. The writ petitioner is working as Sanitary Worker in the Corporation of Chennai. Certain allegations are raised against him and Charge Memo was issued against the writ petitioner on 09.01.2017. Pursuant to the Charge Memo, the Enquiry Officer was also appointed on 18.02.2017. The Enquiry Officer conducted an enquiry and submitted his final report on 13.03.2017. The writ petitioner also submitted his objection / explanation on the enquiry report on 05.06.2017. The personal hearing was also accorded and the writ petitioner has availed an opportunity given to him during the course of enquiry. The only grievance expressed by the writ petitioner is that in spite of the same, final orders are yet to be passed by the Disciplinary Authority.

This Court is of the opinion that the enquiry has also been completed and therefore, there cannot be any delay in passing orders in the disciplinary proceedings. Accordingly, the respondent is directed to consider the materials available on records on merits and in accordance with law and pass final orders in the Disciplinary Proceedings within eight weeks from the date of receipt of copy of this order. In the result, the writ petition is disposed of. No costs.
