Petition praying to issue a Writ of Certiorarified Mandamus to call for the records on the file of the first respondent in connection with the order passed by him in his proc. O Mu.No 1368/A1/99 dated 19.3.1999 and quash the same and direct the respondents to allow the petitioner to join service as per the appointment order of the second respondent in Na.Ka. 4417/A1/98 dated 4.1.99 with all monetary and service benefits . For Appellants : Mr.T.N.Rajagopalan Special Government.

2. It is pointed out that a common order has been passed disposing of two writ petitions on 30.03.2009, being W.P.Nos.38507 of 2006 and 19935 of 2007, both by the same original petitioner. Apparently, two appeals were filed separately. The present appeal is against the order in W.P.No.19935 of 2007. In respect of W.P.No.38507 of 2006, Writ Appeal No.9102 of 2009 is stated to have been filed, which was dismissed on 05.10.2010 with a direction to the appellants to comply with the directions in the impugned order.

3. The matter being one of compassionate appointment, and there being common order qua the same person (the reliefs are linked, though worded differently assailing the same order), this appeal must also necessarily fail and is accordingly dismissed. No costs.

4.Interim order stand vacated.

5. We may however note that as per learned Special Government Pleader on instructions, the respondent is stated not to have approached the department over this period of time. Copy of the order be sent to the respondent through court process without batta.
