Criminal Original Petition filed under Section 482 of Cr.P.C. directing the learned Principal District & Sessions Judge, (Special Court under SC & ST Atrocities Act) at Ariyalur, Ariyalur District to accept the surrender of the petitioners herein concerned in Spl.S.C.No.53 of 2019, on the file of Learned Principal District & Sessions Judge, (Special Court under SC & ST Atrocities Act) at Ariyalur, Ariyalur District and consider the bail petition on the same day itself. ORDER
This Criminal Original Petition has been laid by the petitioners seeking direction to the Principal District & Sessions Judge, (Special Court under SC & ST Atrocities Act) Ariyalur District, to accept the surrender of the petitioners herein in Spl.S.C.No.53 of 2019, on the file of the Principal District & Sessions Judge, (Special Court under SC & ST Atrocities Act), Ariyalur District and consider the bail petition on the same day itself.
2. According to the petitioners, they stand arrayed as accused in crime No.74 of 2019, for the alleged offences under
Sections 147, 148, 149, 294 (b), 323, 324, 341 and 307 IPC r/w 3
(1) (r) (s), 3(2)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Act 2015 and Section 3 of TNPPDL Act and Section 4 of TNWH Act. According to the petitioners, they have not committed the offences put forth against them and on account of the false case alleged against them, the petitioners are necessitated to seek for necessary directions.
3. Considering the facts and circumstances of the case and in the interest of justice, I deem it fit to issue the following directions.
(i) The petitioners shall surrender before the Principal District & Sessions Judge, (Special Court under SC & ST Atrocities Act), Ariyalur, within 10 days from the date of receipt of copy of this order.
(ii) On the petitioners surrendering before the Principal District & Sessions Judge, (Special Court under SC & ST Atrocities Act), Ariyalur, and filing the bail application, the Principal District & Sessions Judge, (Special Court under SC & ST Atrocities Act), Ariyalur is directed to consider and dispose of the bail application as expeditiously as possible, preferably on the date of surrender in accordance with law.
4. Accordingly, the Criminal Original Petition is disposed of.
