[ Respondents] Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of mandamus directing the 3rd respondent to issue joint patta in the name of petitioners in respect of the property situated in Survey No.1 Kondapalayam Village Wallaja Taluk Vellore District totally to an extent of 2.38 Acres by considering the petitioners representation dated 21.03.2017 on the light of the proceedings of the 2nd respondent in O.Mu. A4/ 2733/ 2017 dated 08.04.2017 within a stipulated period of time.

ORDER

Mr.E.Balamurugan, learned Additional Government Pleader takes notice for the respondents. By consent, the main writ petition is taken up for disposal at the admission stage itself.

2. The petitioners have filed the above writ petition to issue a writ of mandamus directing the 3rd respondent to issue joint patta in their names in respect of the property situated in Survey No.1, Kondapalayam Village, Wallaja Taluk, Vellore https://hcservices.ecourts.gov.in/hcservices/

District, measuring an extent of 2.38 Acres, by considering their representation dated 21.03.2017, in the light of the proceedings of the 2nd respondent dated 08.04.2017, within a time frame.

3. The learned counsel appearing for the petitioners submitted that inspite of the petitioners representation dated 21.03.2017, the 3rd respondent has not passed any order so far.

4. Mr.D.Balamurugan, learned Additional Government Pleader appearing for the respondents submitted that the 3rd respondent may be directed to consider the petitioners representation and pass orders in accordance with law, after giving notice to all the interested parties.

5. In view of the submissions made by the learned counsel on either side, without expressing any opinion with regard to the merits of the case, I direct the 3rd respondent to consider the petitioners representation dated 21.03.2017 and pass orders in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order, after giving notice to all the interested parties.

With this observation, the writ petition is disposed of. No costs.
