Crl.O.P.No.12938 of 2024 T.V.THAMILSELVI, J.

The petitioner, who was arrested and remanded to judicial custody on 02.05.2024 in Crime No.36 of 2024, for the offences punishable under Section 379 of IPC, seeks bail.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he is no way connected with the alleged offence, whereas, he has been falsely implicated in this case. He further submitted that the petitioner is suffering incarceration from 02.05.2024 and he is ready to abide any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

3. Learned Government Advocate (Crl.Side) appearing for the respondent police raised objection for granting bail to the petitioner stating that, petitioner had stolen a sum of Rs.2,14,000/- from the defacto complainant by break opening his scooter. He further submitted that, stolen property has not yet been fully recovered and the petitioner is an habitual offendor having several previous cases of similar in nature.

4. Considering the gravity of the offence committed by the petitioner that stealing money from the people by diverting their attention and also taking note of the the stolen property has not been fully recovered, this Court is not inclined to grant bail to the petitioner.
