(Order of the Court was made by Dr.ANITA SUMANTH.,J.) The petitioner seeks condonation of delay of 106 days in filing the Original Side Appeal.

2. Mr.P.Venkatraman, learned counsel for the respondent would fairly state that the respondent objects only in regard to certain allegations that have been made in the petition. However, he has no serious objection to the delay condonation.

3. Hence, keeping aside the question of allegations, for the reasons set out in the accompanying affidavit, the delay of 106 days in filing the Original side Appeal is condoned and this Miscellaneous Petition is ordered.

4. Registry is directed to number the Original Side Appeal, if it is otherwise in order, and list the same for admission.
