O R D E R

This Criminal Original Petition is filed to call for the records in P.R.C.No.12 of 2016 on the file of the Judicial Magistrate No.II, Ponneri and quash the same against the petitioner.

2. None of the ground raised by the petitioner herein will fall under the exception in Section 482 Cr.P.C., for quashing the charge sheet. It is open to the petitioner to raise the grounds now raised during the Course of trial. This Court has scrupulously refraining from addressing any of the grounds, since such finding may have a bearing on the trial and further course of proceedings.

3. In the light of the above observations, the Criminal Original Petition stands closed. Since the First Information Report was registered in the year 2010 and the charge sheet came

to be filed in the year 2016, the trial Court shall endeavour to complete the committal proceedings atleast within a period of three months. It is open to the trial Court to split up the case insofar as the absconding accused are concerned. Consequently, connected Miscellaneous Petition is closed.
