Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorarified Mandamus relating to the impugned order passed by the 1st respondent in Na.Ka.No.A3/21993/2016 dated 07.04.2017, quash the same, consequently direct the 2nd respondent to consider the petitioner for compassionate appointment. ORDER
The writ petitioner move this writ petition questioning the order of the 1st respondent issued in Na.Ka.No.A3/21993/2016 dated 07.04.2016. On perusal of the order, this Court has found that in the earlier writ petition filed in W.P.No.2426/2017, this Court has passed an order on 01.02.2017 directing the respondents to consider the representation submitted by the petitioner on 02.01.2017 and pass orders on merits. Pursuant to the direction issued by this Court, the present Impugned Order dated 07.04.2017 was issued by the 1st respondent. The Impugned Order states that the name of the writ petitioner has been registered in the list of persons waiting for Compassionate Appointment. Thus, the claim of the writ petitioner will be considered in accordance with the seniority of persons waiting for Compassionate Appointment. This Court is of the view that such an order can never be construed as a grievance so as to issue the writ under Article 226 of the https://hcservices.ecourts.gov.in/hcservices/
Constitution of India. The writ petitioner cannot be considered as an aggrieved person under law.
The writ petitioner has to wait for his turn to get his opportunity of appointment on Compassionate Ground. Thus, there is no merits in this writ petition.
