This Civil Miscellaneous Petition is filed seeking exemption from paying the Court fee for a sum of Rs.80,824/- in the above C.M.A.SR.No.48667 of 2022.

2.The learned counsel appearing for the petitioners submitted that challenging the very same award, the 2nd respondent-Royal Sundaram General Insurance Company Limited filed an appeal in C.M.A.No.669 of 2022. This Court, by the order dated 23.03.2022 made in C.M.P.No.4761 of 2022 in C.M.A.No.669 of 2022, granted interim stay of the award on condition that the 2nd respondent shall deposit a sum of Rs.53,83,535/- on or before 26.05.2022. As per the order of this Court dated 23.03.2022, the 2nd respondent deposited the said amount. The petitioners have not withdrawn any amount and prayed for exemption of Court fee.

3.Heard the learned counsel appearing for the petitioners.

4.Recording the submission made by the learned counsel appearing for the petitioners, this Civil Miscellaneous Petition is ordered, exempting the petitioners from paying the Court fee for a sum of Rs.80,824/- for the present. The petitioners are directed to pay the Court fee as and when they withdraw the amount deposited by the 2nd respondent pending appeal or on the date of disposal of the appeal.
