ORDER
The petitioner had earlier lodged a complaint dated 08.10.2024 before the 3rd respondent alleging that around ten unidentified persons entered her house armed with wooden logs and iron rods and assaulted both the petitioner and her husband. It was further alleged that the assailants outraged the modesty of the petitioner. When questioned about their conduct, the assailants informed her that her husband had committed an immoral and grievous offence. Thereafter, the petitioner underwent treatment at a hospital and lodged the aforesaid complaint.
2. Since no action was taken on her complaint, the petitioner submitted a representation to the Superintendent of Police. Even thereafter, no action was forthcoming from the respondent Police. Consequently, the petitioner filed a petition under Section 154(3) Cr.P.C. before the Additional Mahila Court, Tiruvallur, which was taken on file as C.M.P. No.725 of 2025. Upon hearing the learned counsel for the petitioner, the learned Judicial Magistrate, by order dated 24.03.2025, allowed the petition and directed the respondent Police to act in accordance with the dictum laid down by the Hon'ble Supreme Court in Page No.2 of 6
Lalita Kumari v. Government of Uttar Pradesh and Others reported in (2014) 2 SCC 1. Despite the said direction, no action was taken. Hence, the present petition has been filed.

The learned counsel appearing for the Government of Tamil Nadu filed a status report and submitted that, upon receipt of the complaint lodged by the petitioner alleging offences punishable under Sections 191(2), 191(3), 74, 118, 115(2), 351(2), 351(3) and 109 of the Bharatiya Nyaya Sanhita, 2023, an enquiry was conducted. During the course of enquiry, it was found that one Velmurugan and one Janaki had already lodged a complaint before the Pattabiram All Women Police Station on 09.10.2024, which was assigned CSR No.321 of 2024. After enquiry, a case was registered in Crime No.12 of 2024 for offences punishable under Sections 11(i) and 11(iii) read with Section 12 of the Protection of Children from Sexual Offences Act, 2012.
4. It was further submitted that, upon completion of investigation in Crime No.12 of 2024, a final report was filed before the competent Court, and the same has been taken on file as Spl.S.C. No.237 of 2024. The case is presently pending trial and is posted on 09.06.2026 for the examination of the Investigating Officer.

The learned Government counsel further submitted that, with regard to the complaint lodged by the petitioner, a report was filed before the Additional Mahila Court, Tiruvallur, stating that no prima facie materials were available to register a criminal case based on the allegations made by the petitioner. The said report, dated 10.03.2026, was also served upon the petitioner through Registered Post.

In view of the status report filed by the respondent Police, it is seen that an enquiry was conducted on the petitioner's complaint and a closure report was filed before the jurisdictional Court stating that no prima facie materials were available for registration of a case. The said report has also been communicated to the petitioner through registered post. Therefore, no further direction is required in the present petition and the same is liable to be dismissed.
