( Criminal Jurisdiction ) Monday, the Seventeenth day of June Two Thousand Nineteen PRESENT The Hon`ble Mr Justice A.D.JAGADISH CHANDIRA CRIMINAL MISCELLANEOUS PETITION No.7609 of 2019 IN CRL.A.6 of 2019 VENKATARAMANAN [PETITIONER/APPELLANT 1ST ACCUSED ] Vs STATE REP.BY [ RESPONDENT/COMPLAINANT ] THE INSPECTOR OF POLICE, CBI, ACB, CHENNAI (R.C.NO.50(A)/2004/CBI/ACB/CHENNAI) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to (i) To relax the condition imposed upon the petitioner/appellant /1st accused to report before the trial court on the first working day of every month in Crl.A.6 of 2019 against C.C.30 of 2006 on the file of the learned XIth Additional Special Judge for CBI Cases at Chennai, pending disposal of the Crl.A.No.6 of 2019.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.V.KRISHNAMOORTHY, Advocate for the petitioner, and of MR.K.SRIVIVASAN, Special Public Prosecutor for CBI-cases, on behalf of the Respondent, the court made the following order:- The above petition is filed seeking to relax the condition imposed by this Court on the petitioner/A-1 vide order dated 24.01.2019 made in Crl.MP.No.166/2019 in Crl.A.No.6/2019. This Court, in its order dated 24.01.2019, had suspended the sentence imposed on the petitioner with a direction to report before the Trial Court at 10.30 a.m., on the first working day of every English Calendar Month pending appeal.

The learned counsel for the petitioner would submit that the petitioner is a Senior Citizen, aged about 71 years and that he is suffering from heart ailment and would seek that the condition of appearing before the Trial Court on the first working day of every month, be modified.

Heard the learned Special Public Prosecutor [CBI cases] and also perused the Medical Certificate.

Taking into consideration the medical condition and the age of the petitioner, the condition imposed vide order dated 24.01.2019, is hereby modified and the petitioner shall appear before the Trial Court once in three months commencing from the first working day of September 2019 pending Appeal.

The petition is ordered accordingly.
