ORDER

The petitioner who is the first accused in the case in Crime No.36 of 2009 has come forward with this petition for earlier disposal of the C.C.No.24 of 2011 on the file of the learned Judicial Magistrate No.1, Chengalpattu.

2.The learned counsel appearing for the petitioner would state that the petitioner is facing criminal case along with the second accused and a non-bailable warrant is pending against the second accused and action has been taken against the sureties and the case is pending for a long time for execution of nonbailable warrant against the second accused and hence, prays for earlier disposal of the case.

3.Heard the submissions made by the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor.

4.Considering the submissions made on either side, this Court directs the learned Judicial Magistrate No.1, Chengalpattu to split up the case in C.C.No.24 of 2011 in accordance with law and dispose of the same.

5.At this juncture, it is represented that now the case has been split up. In view of the representation, the learned Judicial Magistrate No.1, Chengalpattu is directed to dispose of the case in C.C.No.24 of 2011, within a period of two months from the date of receipt of a copy of this order. 6.This Criminal Original Petition is accordingly disposed of.
