The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 420 of IPC, in Crime No. 05 of 2023, seeks anticipatory bail.

2. The case of the prosecution as per the defacto complainant David, is that the petitioner along with other accused persons under the guise of giving rent on monthly basis had taken the defacto complainant's vehicle and later on, they had not returned the vehicle and cheated the defacto complainant. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and a false complaint has been given against him. He would further submit that he has nothing to do with the alleged offence. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.side) appearing for the respondent would submit that the petitioner along with two other accused persons cheated the defacto complainant by taking the vehicle on monthly

basis and not returned the vehicle to the defacto complainant. He would further submit that A2 and A3 have been arrested and released on statutory bail. However, the vehicle has not been recovered and the petitioner is absconding. However, the custody interrogation of the petitioner is required for securing the vehicle and he would seek for dismissal of the anticipatory bail.

5. Heard the learned counsel for the petitioner and learned Government Advocate (Crl. Side) and perused the materials available on record.

6. Taking into consideration the facts of the case and the submissions made by the learned counsel and also the fact that the custodial interrogation of the petitioner is required for securing the vehicle, this Court is not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, this Criminal Original Petition is dismissed. 07.06.2023 drl
