..Respondent(s) PETITION under Article 226 of the Constitution of India praying for issuance of WRIT OF CERTIORARIFIED MANDAMUS to call for the records pertaining to the Impugned Order bearing no RO-VLR/604/2025CAMP(A) dated 06.12.2025, passed by the 2nd respondent and quash the same and consecutively direct the 2nd respondent to grant ordinary leave for 28 days
without escort to the detenue, Sureshbabu, S/o.Selvaraj aged about 38 years, bearing PID No.305582 at Central Prison, Vellor and pass such further or other orders as this Honble Court may deem fit to the circumstances of the case and thus render justice.

(Order of the Court was made by Dr.Anita Sumanth J.) Mr.C.R.Malarvannan, learned counsel for Government of Tamil Nadu (Criminal Side) accepts notice for the respondents and is armed with necessary instructions to enable a final disposal of the matter, even at this juncture. Hence, by consent of both sides, this Writ Petition is disposed finally, even at the stage of admission.
2. The challenge is to order dated 06.12.2025 rejecting the request of the petitioner dated 20.06.2025 for 28 days ordinary leave without escort to Sureshbabu, S/o Selvaraj (convict), who is incarcerated in Central Prison, Vellore.
3. The convict is the son of the petitioner. Learned counsel for the respondents submits that the reason for rejection in the impugned order is that the period of one year as required under the Tamil Nadu Suspension of
Sentence Rules, 1982 in order to consider the request for ordinary leave has not been completed by the convict at that time. However, as on date, he has completed the period of one year and hence the authorities are willing to re-look into the request of the petitioner dated 20.05.2026.
4. Hence, there is a direction to R2/ Deputy Inspector General of Prison, Vellore to consider the request of the petitioner for 28 days ordinary leave to his son and pass orders in accordance with law, within a period of two (2) days from today, i.e., on or before 03.06.2026 and intimate the same to the petitioner and the convict. Let the authorities pay heed to the position that the father of the convict had passed away on 13.05.2026 for which purpose the convict had been granted leave to attend to the ceremonies.
5. This Writ Petition is disposed as above. Connected Miscellaneous Petition is closed.
