The Secretary To Government v. M Swaminathan (Deseased)1. Nirmala
CMP.Nos.11486 and 11487 of 2024 in Rev.A.Nos.57 and 56 of 2024 S.S.SUNDAR, J.
and P.VELMURUGAN, J.
(Order of the Court was made by S.S.SUNDAR, J.)
1. These CMPs have been filed to grant extension of three months time to comply with the order dated 28.03.2024 passed in Rev.A.Nos.57 and 56 of 2024 respectively.
2. We need not elaborate the facts having regard to the admitted position. As against the order passed in WA.Nos.153 and 154 of 2016, dated 14.12.2017, declaring the Writ Petitioners' entitlement to compensation and directing the SIPCOT to dispose of the claim of the Petitioners, an SLP was filed by the Petitioners and the same was dismissed on 29.10.2021. Later, the Department had filed the review applications before this Court as against the same order passed in the Writ Appeals dated 14.12.2017 and this Court by an order dated 28.03.2024 dismissed the review applications.
3. In view of the huge delay, this Court, while dismissing the review applications, directed the Appellants to disburse the amount of compensation to the eligible persons within a period of eight weeks from the date of receipt of a copy of the order. Since it is admitted before this Court that a sum of Rs.4,86,08,000/- had been deposited with the Sub Court, Kancheepuram, this Court further directed the Principal Sub Court to number the LAOPs for apportionment and decide the entitlement of the writ petitioners to the quantum of compensation on the reference by the Land Acquisition Officer 1/3
who was expected to do within a period of two weeks from the date of receipt of a copy of the order. The Appellant, though admitted that a copy of the order was available with them on 05.04.2024, has come before this Court by way of these petitions to extend the time.
4. The Honourable Supreme Court had dismissed the SLP as against the order passed by this Court in the Writ Appeals. Despite the Writ Appeals were disposed by the order dated 14.12.2017 for about 6 1/2 years back, the Petitioners in the Writ Petition are made to wait and they are yet to get the benefit of the order, which in fact was confirmed by the Honourable Supreme Court. In such circumstances, this Court is unable to find a bona fide reason or cause in extending the time granted by this Court to comply with order dated 28.03.2024. Having regard to the fact that the earlier order passed by this Court in the Writ Appeals was confirmed by the Honourable Supreme Court, this Court is unable to appreciate the contentions of the Petitioners that a substantial question of law is required to be considered in a larger public interest. Hence, these CMPs are dismissed. No costs. (S.S.S.R.J.) & (P.V.J.) 11.06.2024 Srcm 2/3
