Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of mandamus directing the respondents to re-fix the pay of the petitioner on par with her junior as per FR 22-B of the Fundamental Rules and in the light of the orders passed by the 2nd respondent in his proceedings Na.Ka.No.265/A2/2014 dated 28.03.2014. By consent, the writ petition is taken up for final disposal.
The petitioner was initially appointed as Secondary Grade Teacher, vide proceedings of the 2nd respondent dated 03.01.1990 and joined at Primary School, Peranampakkam, Setthupattu Union, Thiruvannamalai District and was transferred to the Panchayat Union Middle School, Kodiyalam, Thellar Union, in the same District, vide proceedings of the 2nd respondent dated 01.10.1990. The petitioner would further state that he was promoted as Primary School Headmaster on 13.06.2003 and since he had acquired the qualification of M.A., B.Ed., he was promoted as Middle School Headmaster, vide proceedings of the 2nd respondent dated 21.07.2007. The grievance expressed by the petitioner is that though he was appointed and promoted much https://hcservices.ecourts.gov.in/hcservices/
earlier to her junior one Thiru K.Venu, the petitioner was drawing lesser salary than her junior. In this regard, she made a representation dated 11.05.2015 to the 1st respondent and it was also followed by another representation dated 21.09.2015 to the 2nd respondent and since no orders have been passed, the petitioner came forward to file this writ petition. Heard the submissions of the learned counsel for the petitioner and Mr.R.Vijayakumar, learned Additional Government Pleader who accepts notice on behalf of the respondents.
This Court, in the light of the above facts and circumstances and without going into the merits of the claim projected by the petitioner, directs the 2nd respondent to consider and dispose of the petitioner's representation dated 21.09.2015 on merits and in accordance with law and pass orders within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken to the petitioner.
The writ petition is disposed of accordingly. No costs.
