Writ Petition is filed under Article 226 of Constitution of India praying to issue a Writ of Mandamus directing the 6th respondent herein to sub divide and create new FMB for the property situated at South Chennai Registration District, Kundrathur, Sub Registrar, Kancheepuram District, Sriperumbhudhur circle, Moulivakkam, bearing Survey No.1/1A part and 6/2 Part in Dhanalakshmi Nagar Plot No.264/3 in extended 422 sq. ft. and 264/4 in extended 418 and overall total extended 840 sq. ft. and grant patta in favor of petitioner For Petitioner : Mr.L.Prakash For Respondents : Mr.P.Ganesan, Government Advocate

This writ petition has been filed for direction to the 6th respondent herein to sub divide and create new FMB for the property situated at South Chennai Registration District, Kundrathur, Sub 2/6
Registrar, Kancheepuram District, Sriperumbhudhur circle, Moulivakkam, bearing Survey No.1/1A part and 6/2 Part in Dhanalakshmi Nagar Plot No.264/3 in extended 422 sq. ft. and 264/4 in extended 418 and overall total extended 840 sq. ft. and to grant patta in favor of petitioner 2.
Without expressing any opinion on merits of the writ petition, the sixth respondent is directed to consider the case of the petitioner as prayed for in this writ petition and, after issuance of notice to the petitioner and counter parties, if any, and giving them opportunity of personal hearing, to pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of copy of this order. It is made clear that though any civil suit is pending, when there is no restriction against the revenue officials to survey or for sub-division, the revenue officials are at free to survey and sub-divide the subject property as per the original title deeds concerned. 3/6
