Prayer in W.P.No.16682 of 2021 : Writ Petition filed under Article 226 of the Constitution of India seeking a Writ of Certiorari, calling for the records relating to the order, dated 19.11.2019 passed by the 1st Additional Labour Court, Chennai in C.P.No.122 of 2018 and to quash the same. Prayer in W.P.No.17631 of 2019 : Writ Petition filed under Article 226 of the Constitution of India seeking a Writ of Certiorari, calling for the records pertaining to the order passed in A.P.No.323 of 2011, dated 30.01.2017 on the file of the first respondent and quash the same. COMMON ORDER These two Writ Petitions are connected to each other and as such, are disposed of by this commons order.

2. W.P.No.16682 of 2021 is filed challenging the order, dated 19.11.2019 in C.P.No.122 of 2018 on the file of the I Additional Labour Court, Chennai. W.P.No.17631 of 2019 is filed challenging the order in A.P.No.323 of 2011, dated 30.01.2017 on the file of the first respondent.

3. When the matters are taken up for hearing, both sides learned Counsel would submit that the matters have since been amicably settled between the parties. The management has deposited a sum of Rs.8,00,000/- to the credit of C.P.No.122 of 2018. It is agreed that the workman can be permitted to withdraw the said amount. The workman is withdrawing the said amount towards all claims of back-wages and other arrears. The management is reinstating the workman forthwith with continuity of service and all other service benefits. Towards all claims of back-wages etc., the sum of Rs.8,00,000/- is received by the workman as full quit.

4.These Writ Petitions are disposed of recording the above terms. The I Additional Labour Court, Chennai shall permit the workman to withdraw the above said sum of Rs.8,00,000/- along with accrued interest upon verification of the identity and the bank account number without insisting for any formal application. Let the reinstatement be done within two weeks from the date of receipt of a web-copy of this order without waiting for a certified copy of this order. From and out of Rs.8,00,000/- received, the workman is liable to pay the employees' contribution in respect of the Pension Fund. Needless to mention that the contribution shall be deposited within a period of eight weeks from today and if the workman deposits the amount within the above time, the same shall be accepted and the workman is not liable to pay any interest. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
